The debtor also loses the benefit of the term when he changes the use of the mortgaged property or when he refuses the creditor access to the mortgaged property to ensure that it is in a good state of maintenance and preservation or, in the case of a loan with periodic interest payments, when he defaults on one or more interest instalments.
In the event of default by the borrower who initially opted for the periodic repayment of interest on a transfer advance loan guaranteed by the guarantee fund for energy renovation under the conditions set out in 4° du I de l’article L. 312-7 du code de la construction et de l’habitation, the lender may offer the borrower the option of annual capitalisation of future interest. By way of derogation from the first paragraph of this article, the borrower then retains the benefit of the term.
