Article L3214-1 of the French Public procurement code

Where they are concluded by contracting entities, service concession contracts concluded with one or more contracting authorities, one or more contracting entities referred to in 1° of Article L. 1212-1 or an economic operator where they benefit from an exclusive right by virtue of a provision adopted by law shall be subject to the rules defined in Title II , provided that this provision is compatible with the Treaty on the Functioning of the European Union and the legal acts of the Union establishing common rules on market access applicable to the activities of network operators.

Article L3214-1

Lorsqu’ils sont conclus par des entités adjudicatrices, sont soumis aux règles définies au titre II les contrats de concession de services conclus avec un ou plusieurs pouvoirs adjudicateurs, une ou plusieurs entités adjudicatrices mentionnées au 1° de l’article L. 1212-1 ou un opérateur économique lorsqu’ils bénéficient, en vertu d’une disposition légalement prise, d’un droit exclusif, à condition que cette disposition soit compatible avec le Traité sur le fonctionnement de l’Union européenne et les actes juridiques de l’Union établissant des règles communes concernant l’accès au marché applicables aux activités d’opérateur de réseau.
