The committee provided for in article L. 3222-5 is made up of :
1° Two psychiatrists, one appointed by the public prosecutor at the court of appeal, the other by the representative of the State in the department ;
2° (Repealed) ;
3° Two representatives of approved associations of patients and families of people with mental disorders, appointed by the State representative in the department;
4° A general practitioner appointed by the State representative in the department.
If it is not possible to appoint one or more members of the committee referred to in this article, leading figures from other departments may be appointed.
Only one of the two psychiatrists mentioned in 1° may practise in an establishment mentioned in article L. 3222-1.
The members of the commission may not be members of the supervisory board, or of a body authorised for this purpose, of a health establishment receiving patients with mental disorders in the department for which the commission is responsible.
They may not, outside the scope of the Commission’s remit, disclose any information they may have obtained about the persons whose situation has been presented to them. Subject to the provisions of 4° and 6° of article L. 3223-1, they are bound by professional secrecy under the conditions set out in articles 226-13 and 226-14 of the French Criminal Code.
The commission appoints its chairman from among its members, under conditions laid down by regulation.
