Article L325-3 of the French Intellectual Property Code

When a collective management organisation is able to grant authorisations for the multi-territorial exploitation of online rights in musical works in accordance with the provisions of this chapter, it may not refuse the mandate to manage such authorisations that another organisation decides to entrust to it which does not offer this type of authorisation for musical works in its own repertoire.

However, the requested organisation is only obliged to accept this mandate if it already grants or proposes to grant multi-territorial exploitation authorisations for the same category of online rights as those which are the subject of the application, in respect of musical works in the repertoire of one or more other organisations.

Article L325-3

Lorsqu’un organisme de gestion collective est en capacité d’octroyer des autorisations d’exploitation multiterritoriales de droits en ligne sur des œuvres musicales conformément aux dispositions du présent chapitre, il ne peut refuser le mandat de gestion de telles autorisations que décide de lui confier un autre organisme qui ne propose pas ce type d’autorisations sur les œuvres musicales de son propre répertoire.

Toutefois, l’organisme sollicité n’est tenu d’accepter ce mandat que s’il octroie déjà ou propose déjà l’octroi d’autorisations d’exploitation multiterritoriales pour la même catégorie de droits en ligne que ceux objets de la demande, sur des œuvres musicales figurant dans le répertoire d’un ou de plusieurs autres organismes.
