When a collective management organisation is able to grant authorisations for the multi-territorial exploitation of online rights in musical works in accordance with the provisions of this chapter, it may not refuse the mandate to manage such authorisations that another organisation decides to entrust to it which does not offer this type of authorisation for musical works in its own repertoire.
However, the requested organisation is only obliged to accept this mandate if it already grants or proposes to grant multi-territorial exploitation authorisations for the same category of online rights as those which are the subject of the application, in respect of musical works in the repertoire of one or more other organisations.
