Article L3253-21 of the French Labour Code

The guarantee institutions mentioned in Article L. 3253-14 pay the judicial representative the sums shown on the statements and remaining unpaid:

1° Within five days of receipt of the statements referred to in 1° and 3° of article L. 3253-19 ;

2° Within eight days of receipt of the statements referred to in 2° and 4° of the same article.

By way of derogation, the advance payment of the employer’s contributions to the financing of the personalised redeployment agreement is paid directly to the bodies responsible for collection mentioned in article L. 5427-1.

The court-appointed representative immediately pays the sums received to the employees and creditor organisations, excluding subrogated creditors, and informs the employees’ representative.

Les institutions de garantie mentionnées à l’article L. 3253-14 versent au mandataire judiciaire les sommes figurant sur les relevés et restées impayées :

1° Dans les cinq jours suivant la réception des relevés mentionnés aux 1° et 3° de l’article L. 3253-19 ;

2° Dans les huit jours suivant la réception des relevés mentionnés aux 2° et 4° du même article.

Par dérogation, l’avance des contributions de l’employeur au financement de la convention de reclassement personnalisé est versée directement aux organismes chargés du recouvrement mentionnés à l’article L. 5427-1.

Le mandataire judiciaire reverse immédiatement les sommes qu’il a reçues aux salariés et organismes créanciers, à l’exclusion des créanciers subrogés, et en informe le représentant des salariés.
