Article L3253-9 of the French Labour Code

Claims arising from the dismissal of employees benefiting from special protection relating to dismissal are also covered where the administrator, the employer or the liquidator, as the case may be, has indicated its intention to terminate the employment contract during the periods mentioned in 2° of Article L. 3253-8.

Sont également couvertes les créances résultant du licenciement des salariés bénéficiaires d’une protection particulière relative au licenciement dès lors que l’administrateur, l’employeur ou le liquidateur, selon le cas, a manifesté, au cours des périodes mentionnées au 2° de l’article L. 3253-8, son intention de rompre le contrat de travail.
