Article L326-23 of the French Insurance Code

The adoption of a reorganisation measure as defined in article L. 323-8 or the opening of winding-up proceedings in a Member State of the European Union other than France in respect of an insurance undertaking whose registered office is located within the territory of a Member State of the European Union other than France which has purchased an asset does not affect the seller’s rights based on a reservation of title, where the asset was located within French territory at the time of the adoption of the measures or the opening of the proceedings.

Where such an undertaking sells an asset, the adoption of reorganisation measures or the opening of winding-up proceedings in respect of that undertaking in another Member State shall not prevent the purchaser from acquiring that asset where, at the time of the opening of such proceedings, it was situated within the territory of the French Republic.

Article L326-23

L’adoption d’une mesure d’assainissement définie à l’article L. 323-8 ou l’ouverture d’une procédure de liquidation dans un Etat membre de l’Union européenne autre que la France à l’égard d’une entreprise d’assurance dont le siège social est situé sur le territoire d’un Etat membre de l’Union européenne autre que la France qui a acheté un bien n’affecte pas les droits du vendeur fondés sur une réserve de propriété, lorsque ce bien se trouvait, au moment de l’adoption des mesures ou de l’ouverture de la procédure, sur le territoire français.

Lorsqu’une telle entreprise vend un bien, l’adoption de mesures d’assainissement ou l’ouverture d’une procédure de liquidation à son égard dans un autre Etat membre ne fait pas obstacle à l’acquisition par l’acheteur de ce bien lorsqu’il se trouvait au moment de l’ouverture d’une telle procédure sur le territoire de la République française.
