Article L326-24 of the French Insurance Code

The provisions of the law of the Member State in which the reorganisation measure was taken or winding-up proceedings were opened in respect of an insurance undertaking whose registered office is situated within the territory of a Member State of the European Union other than France relating to the nullity, nullity, voidability or unenforceability of acts prejudicial to all creditors are not applicable, if the beneficiary of such an act proves that the latter is subject to the law of another Member State and that this law does not allow by any means to challenge this act in the case in question.

Les dispositions de la loi de l’Etat membre dans lequel la mesure d’assainissement a été prise ou la procédure de liquidation a été ouverte à l’égard d’une entreprise d’assurance dont le siège social est situé sur le territoire d’un Etat membre de l’Union européenne autre que la France relatives à la nullité, à l’annulation ou à l’inopposabilité des actes préjudiciables à l’ensemble des créanciers ne sont pas applicables, si le bénéficiaire d’un tel acte apporte la preuve que ce dernier est soumis à la loi d’un autre Etat membre et que cette loi ne permet par aucun moyen d’attaquer cet acte dans l’affaire en cause.
