Article L330-1 of the French Insurance Code

The provisions of this Title apply to insurance undertakings not covered by the Solvency II regime, as referred to in Article L. 310-3-2.

They do not apply to the undertakings referred to in Article L. 310-3-1 or to the undertakings referred to in 2° and 3° of the first paragraph of Article L. 310-1, which are reinsured by an agreement involving the substitution of the ceding undertaking for the performance of the commitments arising from the reinsured insurance contracts.

A decree of the Conseil d’Etat shall specify the terms and conditions for the application of this Title.

Article L330-1

Les dispositions du présent titre s’appliquent aux entreprises d’assurance ne relevant pas du régime dit ” Solvabilité II “, telles que mentionnées à l’article L. 310-3-2.

Elles ne s’appliquent ni aux entreprises mentionnées à l’article L. 310-3-1 ni aux entreprises mentionnées aux 2° et 3° du premier alinéa de l’article L. 310-1, qui sont réassurées par une convention comportant la substitution de l’entreprise cédante pour l’exécution des engagements résultant des contrats d’assurance réassurés.

Un décret en Conseil d’Etat précise les modalités d’application du présent titre.
