Article L3311-1 of the French Labour Code

The provisions of this Title apply to private-law employers and their employees.

They also apply to

1° Public industrial and commercial establishments ;

2° Public administrative establishments when they employ staff under private law.

For the application of this Title, the number of employees and the crossing of the threshold are determined in accordance with the procedures set out in I of article L. 130-1 of the Social Security Code.

A Conseil d’Etat decree determines the conditions under which the provisions of this Title are applicable to public companies and national companies unable to conclude a collective labour agreement mentioned in article L. 3312-5 of this Code.

Article L3311-1

Les dispositions du présent titre sont applicables aux employeurs de droit privé ainsi qu’à leurs salariés.

Elles sont également applicables :

1° Aux établissements publics à caractère industriel et commercial ;

2° Aux établissements publics administratifs lorsqu’ils emploient du personnel de droit privé.

Pour l’application du présent titre, l’effectif salarié et le franchissement du seuil sont déterminés selon les modalités prévues au I de l’article L. 130-1 du code de la sécurité sociale.

Un décret en Conseil d’Etat détermine les conditions dans lesquelles les dispositions du présent titre sont applicables aux entreprises publiques et aux sociétés nationales ne pouvant pas conclure une convention ou un accord collectif de travail mentionné à l’article L. 3312-5 du présent code.
