Article L3323-2 of the French Labour Code

The profit-sharing agreement may provide for the allocation of sums constituting the special profit-sharing reserve:

1° To accounts opened in the name of the interested parties in application of an employee savings plan meeting the conditions set out in Title III ;

2° (repealed).

These provisions apply to agreements concluded after 1st January 2007.

All profit-sharing agreements in existence on the date of promulgation of Law no. 2010-1330 of 9 November 2010 on pension reform must be brought into compliance with this article and article L. 3323-3 by 1 January 2013 at the latest.

Article L3323-2

L’accord de participation peut prévoir l’affectation des sommes constituant la réserve spéciale de participation :

1° A des comptes ouverts au nom des intéressés en application d’un plan d’épargne salariale remplissant les conditions fixées au titre III ;

2° (abrogé).

Ces dispositions sont applicables aux accords conclus après le 1er janvier 2007.


Tout accord de participation existant à la date de promulgation de la loi n° 2010-1330 du 9 novembre 2010 portant réforme des retraites doit être mis en conformité avec le présent article et l’article L. 3323-3 au plus tard le 1er janvier 2013.
