Article L3324-6 of the French Labour Code

The following are treated as periods of presence, regardless of the method of distribution adopted by the agreement:

1° Periods of maternity leave provided for in Article L. 1225-17, paternity and childcare leave provided for in Article L. 1225-35, adoption leave provided for in Article L. 1225-37 and bereavement leave provided for in Article L. 3142-1-1 ;

2° Periods of suspension of the employment contract as a result of an accident at work or an occupational disease pursuant to Article L. 1226-7;

3° Periods of quarantine within the meaning of 2° of I of article L. 3131-1 of the Public Health Code.

Article L3324-6

Sont assimilées à des périodes de présence, quel que soit le mode de répartition retenu par l’accord :

1° Les périodes de congé de maternité prévu à l’article L. 1225-17, de congé de paternité et d’accueil de l’enfant prévu à l’article L. 1225-35, de congé d’adoption prévu à l’article L. 1225-37 et de congé de deuil prévu à l’article L. 3142-1-1 ;

2° Les périodes de suspension du contrat de travail consécutives à un accident du travail ou à une maladie professionnelle en application de l’article L. 1226-7 ;

3° Les périodes de mise en quarantaine au sens du 2° du I de l’article L. 3131-1 du code de la santé publique.
