Article L3326-2 of the French Labour Code

Penalties may be imposed by the court on companies that fail to fulfil their obligations under this Title.

Only the employees of the company in question and the public prosecutor in whose jurisdiction the company is located are entitled to take action.

The penalty is provisional and is liquidated by the judge once the company has fulfilled its obligations. When liquidating the astreinte, account is taken in particular of the damage actually caused and the resistance put up by the company.

Des astreintes peuvent être prononcées par le juge judiciaire contre les entreprises qui n’exécutent pas les obligations qui leur incombent en application du présent titre.

Les salariés de l’entreprise en cause et le procureur de la République dans le ressort duquel cette entreprise est située ont seuls qualité pour agir.

L’astreinte a un caractère provisoire et est liquidée par le juge après exécution par l’entreprise de ses obligations. Il est tenu compte, lors de sa liquidation, notamment du préjudice effectivement causé et de la résistance opposée par l’entreprise.
