Article L3331-6 of the French Public Health Code

The owner of a leased premises may not, notwithstanding any agreement to the contrary, even if previously entered into, oppose the conversion, by the lessee or the transferee of the right to the lease, of a 3rd or 4th category public house into another business, provided, however, that this does not cause greater inconvenience to the building, its occupants or the neighbourhood than the inconvenience resulting from the operation of the business no longer in existence.

The occupier must inform the owner by registered letter, with acknowledgement of receipt, before proceeding with the planned changes.

In the absence of agreement between the parties, the lease contract must be adapted to the new operating conditions in accordance with the conditions laid down for commercial leases.

Le propriétaire d’un local donné à bail ne peut, nonobstant toute convention contraire, même antérieurement conclue, s’opposer à la transformation, réalisée par le locataire ou le cessionnaire du droit au bail, d’un débit de boissons de 3e ou 4e catégorie en un autre commerce, à la condition toutefois qu’il ne puisse en résulter, pour l’immeuble, ses habitants ou le voisinage, des inconvénients supérieurs à ceux découlant de l’exploitation du fonds supprimé.

L’occupant doit, avant de procéder aux modifications envisagées, informer le propriétaire, par lettre recommandée, avec demande d’avis de réception.

L’adaptation du contrat de bail aux conditions d’exploitation nouvelles est, à défaut d’accord entre les parties, effectuée dans les conditions prévues pour les baux de locaux à usage commercial.
