The following may not operate on-trade drinks outlets:
1° Persons convicted of a common crime or one of the offences listed in articles 225-5, 225-6, 225-7 and 225-10 of the Criminal Code;
2° Those who have been sentenced to at least one month’s imprisonment for theft, fraud, breach of trust, receiving stolen goods, skulduggery, receiving stolen goods, public indecency, running a gambling house, taking illegal bets on horse races, selling falsified goods or goods harmful to health, breaching the legal or regulatory provisions on narcotics or for a repeat offence of assault and battery or public drunkenness.
Incapacity is perpetual for all persons mentioned in 1°. It ceases five years after their conviction with regard to those mentioned in 2°, if during these five years they have not incurred any correctional prison sentence. Incapacity ceases in the event of rehabilitation.
The disqualification provided for in this article may be imposed on persons convicted of the offence provided for in article 227-22 of the Criminal Code.
