Any person found to be intoxicated in public places shall, as a police measure, be taken at his own expense by officers of the national police force, members of the national gendarmerie, municipal police officers or rural wardens, after having undergone a medical examination, carried out within or outside the municipality, certifying that the person’s state of health does not preclude it, to the nearest national police or gendarmerie station or to a security room, where they will be held until they recover their senses.
Where it is not necessary to hear the person referred to in the first paragraph immediately after he or she has come to his or her senses, he or she may, by way of derogation from the same first paragraph, be placed by an officer or agent of the judicial police under the responsibility of a person who vouches for him or her.
