Article L341-48 of the French Consumer Code

Where a conventional loan is usurious, excessive collections under articles L. 314-1 to L. 314-9 are automatically deducted from the normal interest due at the time and, subsidiarily, from the principal of the claim.
If the claim is extinguished in principal and interest, the sums unduly collected are refunded with statutory interest from the day they were paid.

Lorsqu’un prêt conventionnel est usuraire, les perceptions excessives au regard des articles L. 314-1 à L. 314-9 sont imputées de plein droit sur les intérêts normaux alors échus et subsidiairement sur le capital de la créance.
Si la créance est éteinte en capital et intérêts, les sommes indûment perçues sont restituées avec intérêts légaux à compter du jour où elles ont été payées.
