Article L3421-2 of the French Public Health Code

In the case provided for in article L. 3421-1, the courts shall order the confiscation of the substances or plants seized.

However, such confiscation may not be ordered where the offence has been committed in a pharmaceutical dispensary if the offender is only the manager responsible, unless the owner of the dispensary has acted as an accomplice or the possession of these substances or plants is unlawful.

Article L3421-2

Dans le cas prévu par l’article L. 3421-1, les tribunaux ordonnent la confiscation des substances ou plantes saisies.

Cette confiscation ne peut toutefois être prononcée lorsque le délit a été constaté dans une officine pharmaceutique si le délinquant n’est que le gérant responsable, à moins que le propriétaire de l’officine n’ait fait acte de complicité ou que la détention de ces substances ou plantes ne soit illicite.
