Provocation to commit the offence provided for in article L. 3421-1 or one of the offences provided for in articles 222-34 to 222-39 of the French Criminal Code, even if this provocation has not been followed by action, or the fact of presenting these offences in a favourable light, is punishable by five years’ imprisonment and a fine of 75,000 euros.
The same penalties shall apply to incitement, even if unheeded, to the use of substances presented as having the effects of substances or plants classified as narcotics.
When the offence provided for by this article constitutes direct incitement and is committed in teaching or educational establishments or on the premises of the administration, as well as when pupils or members of the public are entering or leaving or in the immediate vicinity of these establishments or premises, the penalties are increased to seven years’ imprisonment and a fine of 100,000 euros.
Where the offence provided for in this article is committed by means of the written or audiovisual press, the specific provisions of the laws governing these matters shall apply with regard to determining who is liable.
Persons guilty of the offences provided for in this article are also liable to the additional penalty of being obliged to complete, at their own expense if necessary, a course to raise awareness of the dangers of using narcotics.
