Article L3512-26 of the French Public Health Code

A decree in the Conseil d’Etat shall determine the conditions for application of this chapter, in particular :

1° The model report referred to in Article L. 3512-7 ;

2° The conditions for application of article L. 3512-16 ;

3° The content of the declarations referred to in articles L. 3512-17 and L. 3512-18, the procedures for their transmission and updating, the nature of the information that is made public and the procedures for such publication;

4° The conditions for the neutrality and uniformity of the packaging of tobacco products provided for in article L. 3512-20, in particular with regard to shape, size, texture and colour, and the procedures for including brand names and trade names on these materials;

5° The categories of elements or devices contributing to the promotion of a tobacco product which are prohibited by application of 1° of Article L. 3512-21;

6° The characteristics that the unique identifier must have, the conditions for designating the supplier of the unique identifier and the cases of physical delivery of the unique identifiers mentioned in Article L. 3512-23, as well as the other conditions for applying Articles L. 3512-24 and L. 3512-25 in terms of traceability and security devices.

Un décret en Conseil d’Etat détermine les conditions d’application du présent chapitre, notamment :

1° Le modèle de rapport mentionné à l’article L. 3512-7 ;

2° Les conditions d’application de l’article L. 3512-16 ;

3° Le contenu des déclarations mentionnées aux articles L. 3512-17 et L. 3512-18, leurs modalités de transmission et d’actualisation, la nature des informations qui sont rendues publiques et les modalités de cette publication ;

4° Les conditions de neutralité et d’uniformisation des conditionnements des produits du tabac prévues à l’article L. 3512-20, notamment de forme, de taille, de texture et de couleur, et les modalités d’inscription des marques et des dénominations commerciales sur ces supports ;

5° Les catégories d’éléments ou dispositifs contribuant à la promotion d’un produit du tabac qui sont interdits par application du 1° de l’article L. 3512-21 ;

6° Les caractéristiques que doit revêtir l’identifiant unique, les conditions de désignation du fournisseur d’identifiant unique et les cas de livraison physique des identifiants uniques, mentionnés à l’article L. 3512-23 ainsi que les autres conditions d’application des articles L. 3512-24 et L. 3512-25 en matière de traçabilité et de dispositif de sécurité.
