Chapter II: Tobacco products

Tobacco products are products that can be consumed and are composed, even partially, of tobacco, whether genetically modified or not. Tobacco products include cigarettes, rolling tobacco, pipe tobacco, water pipe tobacco, cigars, cigarillos, chewing tobacco, snuff and tobacco for oral use. An ingredient is considered to be tobacco, an additive, or any other substance or element present in a finished tobacco product, including paper, filter, ink, capsules and glues.

Tobacco products intended for use by consumers or retailers to make cigarettes are considered to be rolling tobacco. If a product can be used both in a water pipe and as rolling tobacco, it is deemed to be rolling tobacco.

Direct or indirect propaganda or advertising in favour of tobacco, tobacco products or the ingredients defined in article L. 3512-2, as well as any free distribution or sale of a tobacco product at a price lower than that approved in accordance with article 572 of the General Tax Code, are prohibited. Television channels may broadcast motor sport competitions containing direct or indirect advertising for the products mentioned in article L. 3512-5 and which take place in countries where tobacco advertising is permitted.

Smoking is prohibited in public places, particularly schools, and on public transport, except in areas expressly reserved for smokers.
