Article L3823-6 of the French Public Health Code

Infringements of the provisions of articles L. 3611-1 to L. 3611-3 and the regulations adopted for their application are investigated and recorded by officers and agents of the judicial police, in accordance with the Code of Criminal Procedure, as well as by the agents mentioned in article L. 1421-1 of this Code.

To this end, these officers and agents have the powers and prerogatives set out in articles L. 1421-2 and L. 1421-3.

In order to establish an infringement of articles L. 3611-1 and L. 3611-3, these agents may require the transferee to provide proof of majority by producing any official document bearing a photograph.

Les infractions aux prescriptions des articles L. 3611-1 à L. 3611-3 et aux règlements pris pour leur application sont recherchées et constatées par des officiers et agents de police judiciaire, conformément au code de procédure pénale, ainsi que par les agents mentionnés à l’article L. 1421-1 du présent code.

A cet effet, ces fonctionnaires et agents disposent des pouvoirs et prérogatives prévues aux articles L. 1421-2 et L. 1421-3.

Ces agents peuvent, pour constater une infraction aux articles L. 3611-1 et L. 3611-3, exiger que le cessionnaire établisse la preuve de sa majorité par la production de tout document officiel muni d’une photographie.
