I.-Partial access to a professional activity covered by this Part may be granted on a case-by-case basis if the following three conditions are met:
1° The professional is fully qualified to practise, in the country of origin, which is a member of the European Union or a party to the Agreement on the European Economic Area, the professional activity for which he is seeking access to France;
2° The differences between the professional activity legally practised in the country of origin and the corresponding profession in France are so significant that the application of compensatory measures would be tantamount to requiring the applicant to follow the full education and training programme required to gain full access to the profession in France;
3° The professional activity for which the person concerned is seeking access can objectively be separated from other activities relating to the profession in France; the competent French authority shall take account of the fact that the professional activity may or may not be exercised independently in the Member State of origin.
II – Partial access may also be refused if such refusal is justified by overriding reasons relating to the public interest, if it is suitable for guaranteeing the attainment of the objective pursued and if it does not go beyond what is necessary to attain that objective.
