Chapter II: Common provisions on the recognition of professional qualifications

The application for partial access by the person concerned shall be examined, depending on the case, as an application for establishment or for freedom to provide services in the profession concerned. The competent authority decides on applications for establishment after receiving the opinion of the professional body concerned, where applicable.

When practising the activities to which partial access has been granted, the professional shall enjoy the same rights, be subject to the same obligations and incur the same civil, disciplinary and criminal liability as professionals covered, as the case may be, by the provisions relating to establishment or those relating to the freedom to provide services, subject to the provisions of this article. This section shall not apply to professionals who fulfil the conditions required to benefit from automatic recognition of their professional qualifications within the meaning of Directive 2005/36/EC of the European Parliament and of the Council of 7 September 2005 on the recognition of professional qualifications.
