Article L4022-8 of the French Public Health Code

I.- On a proposal from the Haute Autorité de santé and after obtaining the opinion of the Conseil national de la certification périodique, the Minister for Health shall determine the method for drawing up the periodic certification reference frameworks provided for in article L. 4022-7.

II.- After obtaining the opinion of the competent national professional council, the Minister for Health shall determine the periodic certification reference framework for each profession or speciality.After obtaining the opinion of the competent national professional council, the Minister responsible for health shall draw up the periodic certification reference framework for each profession or speciality.

Under conditions laid down by decree, the Minister responsible for health may refer the matter to the Haute Autorité de santé for an opinion when the reference frameworks are being drawn up.

III.-For healthcare professionals covered by article L. 4138-2 of the Defence Code, the order of the Minister for Health mentioned in the first paragraph of II is applicable subject, where applicable, to adaptations made by order of the Minister for Defence and the Minister for Health.

I.-Sur proposition de la Haute Autorité de santé et après avis du conseil national de la certification périodique, le ministre chargé de la santé arrête la méthode d’élaboration des référentiels de certification périodique prévus par l’article L. 4022-7.

II.-Après avis du conseil national professionnel compétent, le ministre chargé de la santé arrête le référentiel de certification périodique de chaque profession ou spécialité.

Dans des conditions fixées par décret, le ministre chargé de la santé peut saisir la Haute Autorité de santé pour avis lors de l’élaboration des référentiels.

III.-Pour les professionnels de santé relevant de l’article L. 4138-2 du code de la défense, l’arrêté du ministre chargé de la santé mentionné au premier alinéa du II est applicable sous réserve, le cas échéant, des adaptations prises par arrêté du ministre de la défense et du ministre chargé de la santé.
