Article L4125-4 of the French Public Health Code

When the territorial jurisdiction of the departmental, regional or inter-regional councils, or of the disciplinary chambers of first instance is modified, the National Council shall arrange for the election of new bodies. These elections must take place at the time normally scheduled for the first partial renewal following publication of the text amending the territorial jurisdiction of these bodies.

In order to allow half of the new bodies to be renewed, if necessary, lots shall be drawn to determine either the members or the pairs whose terms of office are due to expire within three or six years respectively.

In the same case, the National Council may hold new elections for the appointment, within the National Council concerned, of the representatives of the regions or inter-regions affected by the change provided for above.

These elections must take place at the time normally scheduled for the first partial renewal following publication of the text modifying the territorial jurisdiction of the departmental, regional or inter-regional councils, or of the disciplinary chambers of first instance. As soon as they are elected, the newly elected members or pairs are allocated by lot to each of the renewable sections of the National Council.

The departmental, regional or inter-regional councils, disciplinary chambers of first instance and national councils in office at the time of the elections provided for in this article shall remain in office until the new bodies take office.

In the event that the jurisdiction of the departmental, regional or inter-regional councils or the disciplinary chambers of first instance is changed, the National Council shall decide on the transfer of the assets of the former councils to the new councils.

Lorsque le ressort territorial des conseils départementaux, régionaux ou interrégionaux, ou des chambres disciplinaires de première instance est modifié, le Conseil national fait procéder à l’élection de nouvelles instances. Ces élections doivent avoir lieu à l’époque normalement prévue pour le premier renouvellement partiel qui suit la publication du texte modifiant le ressort territorial de ces instances.

Afin de permettre le renouvellement, le cas échéant, par moitié des nouvelles instances, un tirage au sort détermine, soit les membres, soit les binômes dont le mandat vient à expiration respectivement dans les délais de trois ou six ans.

Dans le même cas, le Conseil national peut procéder à de nouvelles élections pour la désignation, au sein du Conseil national intéressé, des représentants des régions ou interrégions affectées par la modification prévue ci-dessus.

Ces élections doivent avoir lieu à l’époque normalement prévue pour le premier renouvellement partiel suivant la publication du texte modifiant le ressort territorial des conseils départementaux, régionaux ou interrégionaux, ou des chambres disciplinaires de première instance. Dès leur élection, les membres ou les binômes nouvellement élus sont répartis par tirage au sort dans chacune des fractions renouvelables du Conseil national.

Les conseils départementaux, régionaux ou interrégionaux, les chambres disciplinaires de première instance et les conseils nationaux en fonctions au moment des élections prévues au présent article restent en place jusqu’à l’entrée en fonctions des nouvelles instances.

Dans le cas où le ressort des conseils départementaux, régionaux ou interrégionaux ou des chambres disciplinaires de première instance est modifié, le Conseil national règle le transfert aux nouveaux conseils du patrimoine des anciens conseils.
