Article L4126-5 of the French Public Health Code

Disciplinary proceedings do not prevent :

1° any proceedings that the Public Prosecutor or private individuals may bring before the criminal courts under the terms of ordinary law; or

2° civil actions for damages for an offence or quasi-offence; or

3° Nor in disciplinary proceedings before the administration to which the civil servant doctor, dental surgeon or midwife belongs;

4° Nor in proceedings which may be brought against doctors, dental surgeons or midwives on account of abuses of which they may be accused in their participation in medical care provided for by social laws.

L’exercice de l’action disciplinaire ne met obstacle :

1° Ni aux poursuites que le ministère public ou les particuliers peuvent intenter devant les tribunaux répressifs dans les termes du droit commun ;

2° Ni aux actions civiles en réparation d’un délit ou d’un quasi-délit ;

3° Ni à l’action disciplinaire devant l’administration dont dépend le médecin, le chirurgien-dentiste ou la sage-femme fonctionnaire ;

4° Ni aux instances qui peuvent être engagées contre les médecins, les chirurgiens-dentistes ou les sages-femmes en raison des abus qui leur seraient reprochés dans leur participation aux soins médicaux prévus par les lois sociales.
