Article L4132-2 of the French Labour Code

When the staff representative on the social and economic committee alerts the employer in application of article L. 4131-2, he shall record his opinion in writing under conditions determined by regulation.

The employer immediately carries out an investigation with the representative of the Social and Economic Committee who alerted him to the danger and takes the necessary steps to remedy the situation.

Article L4132-2

Lorsque le représentant du personnel au comité social et économique alerte l’employeur en application de l’article L. 4131-2, il consigne son avis par écrit dans des conditions déterminées par voie réglementaire.

L’employeur procède immédiatement à une enquête avec le représentant du comité social et économique qui lui a signalé le danger et prend les dispositions nécessaires pour y remédier.
