Article L4135-9-2 of the French General Code of Local Authorities

On the occasion of the general renewal of the members of the regional council, any president of the regional council or any vice-president delegated by the latter who, in order to carry out his mandate, had ceased to carry out his professional activity shall receive, at his request, a differential end-of-mandate allowance if he finds himself in one of the following situations:

– being registered with the institution mentioned in article L. 5312-1 of the French Labour Code in accordance with the provisions of l’article L. 5411-1 of the same code;

– have resumed a professional activity providing them with an income lower than the office allowances they received for their last elective office.

The monthly amount of the allowance is at most equal to 80% of the difference between the amount of the gross monthly allowance the person concerned received for the performance of their duties, within the limit of the maximum rates set in article L. 4135-17, and all the resources he or she receives at the end of the term of office.

The allowance is paid for a period of one year at most. It cannot be combined with those provided for under articles L. 2123-11-2 and L. 3123-9-2. From the seventh month following the start of payment of the allowance, the rate mentioned in the fourth paragraph is at most equal to 40%.

The financing of this allowance is provided under the conditions laid down by Article L. 1621-2.

The terms and conditions for the application of this article are determined by decree in the Conseil d’Etat.

Article L4135-9-2

A l’occasion du renouvellement général des membres du conseil régional, tout président du conseil régional ou tout vice-président ayant reçu délégation de celui-ci qui, pour l’exercice de son mandat, avait cessé d’exercer son activité professionnelle perçoit, sur sa demande, une allocation différentielle de fin de mandat s’il se trouve dans l’une des situations suivantes :

– être inscrit à l’institution mentionnée à l’article L. 5312-1 du code du travail conformément aux dispositions de l’article L. 5411-1 du même code ;

– avoir repris une activité professionnelle lui procurant des revenus inférieurs aux indemnités de fonction qu’il percevait au titre de sa dernière fonction élective.

Le montant mensuel de l’allocation est au plus égal à 80 % de la différence entre le montant de l’indemnité brute mensuelle que l’intéressé percevait pour l’exercice de ses fonctions, dans la limite des taux maximaux fixés à l’article L. 4135-17, et l’ensemble des ressources qu’il perçoit à l’issue du mandat.

L’allocation est versée pendant une période d’un an au plus. Elle n’est pas cumulable avec celles prévues par les articles L. 2123-11-2 et L. 3123-9-2. A compter du septième mois suivant le début du versement de l’allocation, le taux mentionné au quatrième alinéa est au plus égal à 40 %.

Le financement de cette allocation est assuré dans les conditions prévues par l’article L. 1621-2.

Les modalités d’application du présent article sont déterminées par décret en Conseil d’Etat.
