Article L4142-3 of the French Labour Code

In establishments comprising at least one facility on the list provided for in article L. 515-36 of the Environment Code or mentioned in article L. 211-2 of the Mining Code, the employer shall define and implement risk training for the managers of external companies and their employees, as well as for the self-employed workers it takes on, in accordance with the conditions set out in article L. 4522-2.

By way of derogation from the provisions of article L. 4141-4, the financing of these training initiatives is the responsibility of the user company.

Dans les établissements comprenant au moins une installation figurant sur la liste prévue à l’article L. 515-36 du code de l’environnement ou mentionnée à l’article L. 211-2 du code minier, l’employeur définit et met en oeuvre une formation aux risques des chefs d’entreprises extérieures et de leurs salariés ainsi que des travailleurs indépendants qu’il accueille, dans les conditions prévues à l’article L. 4522-2.

Par dérogation aux dispositions à l’article L. 4141-4, le financement de ces actions de formation est à la charge de l’entreprise utilisatrice.
