As an exception to the second and third paragraphs of article L. 131-2, penalties set to force the occupier of premises to leave the premises are always provisional in nature and are reviewed and settled by the judge once the eviction order has been enforced.

Par exception aux deuxième et troisième alinéas de l’article L. 131-2, les astreintes fixées pour obliger l’occupant d’un local à quitter les lieux ont toujours un caractère provisoire et sont révisées et liquidées par le juge une fois la décision d’expulsion exécutée.
