Article L421-1 of the French Consumer Code

For the purposes of this Title, the following definitions shall apply:
1° Producer:
a) The manufacturer of the product, where he is established in the European Union and any other person who presents himself as the manufacturer by affixing his name, trade mark or other distinctive sign to the product, or the person who carries out the reconditioning of the product ;
b) The manufacturer’s representative, when the manufacturer is not established in the European Union or, if there is no representative established in the European Union, the importer of the product;
c) Other professionals in the marketing chain, insofar as their activities may affect the safety characteristics of a product;
2° Distributor : Any professional in the marketing chain whose activity does not affect the safety characteristics of the product.

Article L421-1

Pour l’application du présent titre, on entend par :
1° Producteur:
a) Le fabricant du produit, lorsqu’il est établi dans l’Union européenne et toute autre personne qui se présente comme fabricant en apposant sur le produit son nom, sa marque ou un autre signe distinctif, ou celui qui procède à la remise en état du produit ;
b) Le représentant du fabricant, lorsque celui-ci n’est pas établi dans l’Union européenne ou, en l’absence de représentant établi dans l’Union européenne, l’importateur du produit ;
c) Les autres professionnels de la chaîne de commercialisation, dans la mesure où leurs activités peuvent affecter les caractéristiques de sécurité d’un produit ;
2° Distributeur : tout professionnel de la chaîne de commercialisation dont l’activité n’a pas d’incidence sur les caractéristiques de sécurité du produit.
