Article L421-11 of the French Insurance Code

The guarantee fund is responsible for compensating the victims of accidents caused by vehicles whose use requires compulsory third party liability insurance and which are normally based in mainland France or Monaco when these accidents occur on the territory of a State referred to in article L. 211-4 with the exception of France and Monaco.

Assistance from the guarantee fund is subject to the following conditions:

The person responsible for the damage must not be covered by compulsory civil liability insurance;

Victims are compensated in accordance with the national legislation of the State in whose territory the accident occurred.

Article L421-11

Le fonds de garantie est chargé de l’indemnisation des victimes d’accidents causés par les véhicules dont la circulation entraîne l’application d’une obligation d’assurance de la responsabilité civile et qui ont leur stationnement habituel en France métropolitaine ou à Monaco lorsque ces accidents surviennent sur le territoire d’un Etat visé à l’article L. 211-4 à l’exception de la France et de Monaco.

L’intervention du fonds de garantie est subordonnée aux conditions ci-après :

Le responsable des dommages ne doit pas disposer de la garantie d’assurance obligatoire de responsabilité civile ;

L’indemnisation des victimes est effectuée dans les conditions prévues par la législation nationale de l’Etat sur le territoire duquel s’est produit l’accident.
