Article L421-12 of the French Insurance Code

The guarantee fund is also responsible for compensating victims when the accident caused by a vehicle referred to in article L. 421-11 occurs during a journey directly linking two territories where the Treaty establishing the European Economic Community is applicable.

In such cases, the guarantee fund’s involvement is subject to the conditions set out in article L. 421-11 and to the following conditions:

-There must be no national insurance office for the territory covered;

-The victims must be nationals of a State referred to in article L. 211-4.

In this case, compensation is paid to the victims in accordance with the conditions laid down by the national legislation on compulsory insurance in force in the State where the vehicle which caused the accident is normally based.

Le fonds de garantie est également chargé de l’indemnisation des victimes lorsque l’accident causé par un véhicule mentionné à l’article L. 421-11 s’est produit pendant le trajet reliant directement deux territoires où le traité instituant la Communauté économique européenne est applicable.

L’intervention du fonds de garantie est, dans ce cas, subordonnée aux conditions prévues à l’article L. 421-11 ainsi qu’aux conditions suivantes :

-il doit n’exister pour le territoire parcouru aucun bureau national d’assurance ;

-Les victimes doivent être ressortissantes d’un Etat visé à l’article L. 211-4.

L’indemnisation des victimes est, dans ce cas, effectuée dans les conditions prévues par la législation nationale sur l’obligation d’assurance en vigueur dans l’Etat où le véhicule qui a causé l’accident a son stationnement habituel.
