Article L4212-1 of the French Public Health Code

It is punishable by a fine of 3750 euros for a doctor to dispense medicinal products :

1° Without the authorisation provided for in article L. 4211-3 ;

2° Not included on the list drawn up by the Minister of Health under article L. 4211-3 ;

3° Other than those prescribed by him during the consultation;

4° To persons to whom he does not provide care;

5° At the home of a patient located in a locality not mentioned in the authorisation provided for in article L. 4211-3.

Article L4212-1

Est puni de 3750 euros d’amende le fait pour un médecin de délivrer des médicaments :

1° Sans l’autorisation prévue à l’article L. 4211-3 ;

2° Non inscrits sur la liste établie par le ministre chargé de la santé prévue à l’article L. 4211-3 ;

3° Autres que ceux prescrits par lui au cours de la consultation ;

4° A des personnes auxquelles il ne donne pas de soins ;

5° Au domicile d’un malade situé dans une localité non mentionnée dans l’autorisation prévue à l’article L. 4211-3.
