Article L422-1-1 of the French Insurance Code

The guarantee fund referred to in article L. 422-1 may request any administration or service of the State or public authorities, any social security organisation, any organisation managing social benefits, any employer as well as financial establishments or insurance companies likely to compensate for all or part of the loss, to gather and communicate any information they have or may have relating to the performance of any of their obligations, without being bound by professional secrecy.

The guarantee fund shall inform the victim referred to in article L. 126-1 prior to any requisition likely to concern information relating to his or her person or situation and shall seek his or her prior agreement when the requisition is addressed to his or her employer.

The information gathered in this way may not be used for any purpose other than the investigation of the compensation claim and its disclosure is prohibited. The persons who have access to the documents and information provided to the guarantee fund are bound by professional secrecy under the conditions and penalties set out in articles 226-13 and 226-14 of the French penal code.

Le fonds de garantie mentionné à l’article L. 422-1 peut requérir de toute administration ou tout service de l’Etat et des collectivités publiques, de tout organisme de sécurité sociale, de tout organisme assurant la gestion des prestations sociales, de tout employeur ainsi que des établissements financiers ou entreprises d’assurance susceptibles de réparer tout ou partie du préjudice la réunion et la communication des renseignements dont ceux-ci disposent ou peuvent disposer relatifs à l’exécution de leurs obligations éventuelles, sans que ne puisse lui être opposé le secret professionnel.

Le fonds de garantie informe la victime mentionnée à l’article L. 126-1 avant toute réquisition susceptible de porter sur des renseignements relatifs à sa personne ou à sa situation et sollicite son accord préalable lorsque la réquisition est adressée à son employeur.

Les renseignements ainsi recueillis ne peuvent être utilisés à d’autres fins que l’instruction du dossier d’indemnisation et leur divulgation est interdite. Les personnes qui ont à connaître des documents et informations fournis au fonds de garantie sont tenues au secret professionnel dans les conditions et sous les peines prévues aux articles 226-13 et 226-14 du code pénal.
