Article L422-4 of the French Intellectual Property Code

Persons who wish to be represented in proceedings before the National Institute of Industrial Property may only do so, for acts where the technical nature of the subject matter so requires, through the intermediary of industrial property attorneys whose specialisation, determined pursuant to the last paragraph of Article L. 422-1, is relevant to the act.

The provisions of the previous paragraph do not prevent the use of the services of a lawyer or those of a company or public establishment to which the applicant is contractually linked or those of a specialised professional organisation or those of a professional established on the territory of a Member State of the European Community or of a State party to the Agreement on the European Economic Area acting on an occasional basis and authorised to represent persons before the central industrial property service of that State.

Article L422-4

Les personnes qui souhaitent se faire représenter dans les procédures devant l’Institut national de la propriété industrielle ne peuvent le faire, pour les actes où la technicité de la matière l’impose, que par l’intermédiaire de conseils en propriété industrielle dont la spécialisation, déterminée en application du dernier alinéa de l’article L. 422-1, est en rapport avec l’acte.

Les dispositions de l’alinéa précédent ne font pas obstacle à la faculté de recourir aux services d’un avocat ou à ceux d’une entreprise ou d’un établissement public auxquels le demandeur est contractuellement lié ou à ceux d’une organisation professionnelle spécialisée ou à ceux d’un professionnel établi sur le territoire d’un Etat membre de la Communauté européenne ou d’un Etat partie à l’accord sur l’Espace économique européen intervenant à titre occasionnel et habilité à représenter les personnes devant le service central de la propriété industrielle de cet Etat.
