Article L422-5 of the French Intellectual Property Code

Any person carrying out the activities mentioned in the first paragraph of Article L. 422-1 to 26 November 1990 may, notwithstanding the provisions of Article L. 422-4, represent the persons mentioned in the first paragraph of this Article in the cases provided for by this paragraph, subject to being entered on a special list drawn up by the Director of the Institut national de la propriété industrielle.

Registration is by right, subject to the reservation provided for in the last paragraph of this Article, on condition that the person has requested it by a declaration to the Director of the Institute.

On pain of foreclosure, the declaration must be made, at the latest, two years after the entry into force of the aforementioned loi n° 90-1052 du 26 novembre 1990.

No one may be entered on the list provided for in the first paragraph if they are not of good character.

Article L422-5

Toute personne exerçant les activités mentionnées au premier alinéa de l’article L. 422-1 au 26 novembre 1990 peut, par dérogation aux dispositions de l’article L. 422-4, représenter les personnes mentionnées au premier alinéa de cet article dans les cas prévus par cet alinéa, sous réserve d’être inscrite sur une liste spéciale établie par le directeur de l’Institut national de la propriété industrielle.

L’inscription est de droit, sous la réserve prévue au dernier alinéa du présent article, à la condition que la personne l’ait demandée par une déclaration auprès du directeur de l’Institut.

A peine de forclusion, la déclaration doit être formulée, au plus tard, deux ans après l’entrée en vigueur de la loi n° 90-1052 du 26 novembre 1990 précitée.

Nul ne peut être inscrit sur la liste prévue au premier alinéa s’il n’est pas de bonne moralité.
