A pharmacist who is a national of a Member State of the European Union or a party to the Agreement on the European Economic Area, who is established and legally practises the activities of a pharmacist in a Member State or a party to the Agreement on the European Economic Area, may perform in France, on a temporary and occasional basis, acts of his profession, where applicable in the speciality concerned, without being entered on the roll.
The performance of these acts is subject to a prior declaration, which must be accompanied by supporting documents, the list of which is set by order of the Minister for Health. The service provider must include a declaration of the language skills required to provide the service.
Checks on language proficiency must be proportionate to the activity to be performed and carried out once the professional qualification has been recognised.
The service provider is required to comply with the professional rules applicable in France and is subject to disciplinary jurisdiction.
Where the training qualification is not recognised pursuant to articles L. 4221-4 and L. 4221-5, the professional qualifications of the service provider are verified before the first service is provided. In the event of a substantial difference between the qualifications of the service provider and the training required in France for the practice of the profession of pharmacist, where applicable, in the speciality concerned, which is likely to harm public health, the competent authorities shall subject the professional to an aptitude test.
The service provider may use his evidence of formal qualifications in the language of the State which issued them. He must indicate the place and establishment where he obtained it.
If the evidence of formal qualifications from the home Member State or part of the home Member State is likely to be confused with evidence of formal qualifications requiring additional training in France, the Conseil national de l’ordre may decide that the person concerned will refer to the evidence of formal qualifications from the home Member State or part of the home Member State in an appropriate form indicated by the Conseil national de l’ordre.
The service is provided under the French professional title of pharmacist. However, if the evidence of formal qualifications does not benefit from recognition pursuant to articles L. 4221-4 and L. 4221-5 and if the qualifications have not been verified, the service will be provided under the professional title of the State of establishment, so as to avoid any confusion with the French professional title.
