The use of the title of pharmacist, without fulfilling the conditions required by article L. 4221-1, or the use without right of a diploma, certificate or other title legally required for the practice of this profession, are punishable by the penalties set out in article 433-17 of the French Penal Code .
Natural persons are also liable to the additional penalty of permanent closure or closure for a period of up to five years of the establishment in which the offence was committed.
Legal entities declared criminally liable, under the conditions set out in article 121-2 of the French Penal Code, for the offence defined in this article are liable to the fine set out in article 433-17 of the French Penal Code, in accordance with the procedures set out in article 131-38 of the same code, as well as the penalties set out in 2° to 4° of article 433-25 of the same code.
Failure to comply with the provisions of article L. 4221-14 is treated as equivalent to usurpation of the title of pharmacist.
