Article L423-2 of the French Intellectual Property Code

Decrees in the Council of State shall lay down the conditions for the application of this Title.

They shall specify in particular:

a) The conditions for application of Chapter I;

b) The conditions for application of Article L. 422-1 ;

c) The conditions for application of Article L. 422-4 ;

d) The conditions of application of article L. 422-5 ;

e) The conditions under which the obligation mentioned in b of article L. 422-7 to enable inter-professional grouping with other service providers involved in the innovation process;

f) The conditions for applying the last paragraph of Article L. 422-7 and Article L. 422-7-1, in particular the procedures for applying the disciplinary rules provided for in Article L. 422-10;

g) The rules of professional conduct applicable to industrial property attorneys;

h) The organisation and operating procedures of the Compagnie nationale des conseils en propriété industrielle and the procedures for setting the amount of the fees it collects from its members.

Article L423-2

Des décrets en Conseil d’Etat fixent les conditions d’application du présent titre.

Ils précisent notamment :

a) Les conditions d’application du chapitre Ier ;

b) Les conditions d’application de l’article L. 422-1 ;

c) Les conditions d’application de l’article L. 422-4 ;

d) Les conditions d’application de l’article L. 422-5 ;

e) Les conditions dans lesquelles il peut être dérogé à l’obligation mentionnée au b de l’article L. 422-7 afin de permettre le regroupement interprofessionnel avec d’autres prestataires de services intervenant dans le processus d’innovation ;

f) Les conditions d’application du dernier alinéa de l’article L. 422-7 et de l’article L. 422-7-1, notamment les modalités d’application des règles de discipline prévues à l’article L. 422-10 ;

g) Les règles de déontologie applicables aux conseils en propriété industrielle ;

h) L’organisation et les modalités de fonctionnement de la Compagnie nationale des conseils en propriété industrielle ainsi que les modalités de fixation du montant des cotisations qu’elle perçoit de ses membres.
