Article L4234-4 of the French Public Health Code

The disciplinary chamber of the central councils of each of sections B, C, D, E, G and H is chaired by a serving or honorary member of the body of councillors of the administrative courts and administrative courts of appeal appointed by the vice-president of the Conseil d’Etat on a proposal from the president of the administrative court or administrative court of appeal for a renewable term of six years. One or more alternates are appointed under the same conditions.

No one may perform the duties of chairman or alternate chairman of a disciplinary chamber if they have reached the age of seventy-seven.

The amount of the allowances allocated to the chairmen or deputy chairmen of the disciplinary chambers of the central councils is set by order of the ministers responsible for the budget and health, after consultation with the order.

Their travel expenses are reimbursed under the conditions laid down in the regulations applicable to civil servants.

These allowances and expenses are paid by the central councils.

No assessor of this disciplinary panel may sit when he has had knowledge of the facts of the case due to the exercise of other functions within the Order and in particular when he has taken part in the deliberation by which the Central Council has, where applicable, initiated disciplinary proceedings or appealed the decision made public by the Disciplinary Chamber of First Instance.

La chambre de discipline des conseils centraux de chacune des sections B, C, D, E, G et H est présidée par un membre en fonction ou honoraire du corps des conseillers des tribunaux administratifs et des cours administratives d’appel désigné par le vice-président du Conseil d’Etat sur proposition du président du tribunal administratif ou de la cour administrative d’appel pour une durée de six ans renouvelable. Un ou des suppléants sont nommés dans les mêmes conditions.

Nul ne peut exercer les fonctions de président ou de président suppléant d’une chambre de discipline s’il a atteint l’âge de soixante-dix-sept ans.

Le montant des indemnités allouées aux présidents ou aux présidents suppléants des chambres de discipline des conseils centraux est fixé par arrêté des ministres chargés du budget et de la santé, après consultation de l’ordre.

Leurs frais de déplacement sont remboursés dans les conditions prévues par la réglementation applicable aux fonctionnaires de l’Etat.

Ces indemnités et frais sont à la charge des conseils centraux.

Aucun assesseur de cette formation disciplinaire ne peut siéger lorsqu’il a eu connaissance des faits de la cause à raison de l’exercice d’autres fonctions ordinales et notamment lorsqu’il a participé à la délibération par laquelle le conseil central a, le cas échéant, initié l’action disciplinaire ou fait appel de la décision rendue publique par la chambre de discipline de première instance.
