Injured parties may submit a claim to the compensation body:
a) If, within a period of three months from the date on which the injured party submitted a claim for compensation to the insurer of the vehicle whose use caused the accident or to its claims representative, the insurer or its claims representative has not given a reasoned reply to the matters raised in the claim;
b) If the insurance undertaking has not appointed a claims representative in metropolitan France. In this case, injured parties may not submit a claim to the compensation body if they have submitted a claim for compensation directly to the insurance company of the vehicle whose use caused the accident and if they have received a reasoned reply within three months of submitting the claim;
c) If it is not possible to identify the vehicle of the person responsible for the accident, or if, within two months of the accident, it is impossible to identify the insurance company providing cover.
However, in the cases provided for in a and b, injured parties may not submit a claim to the compensation body if they have taken legal action directly against the insurance undertaking.
