Article L4251-5 of the French General Code of Local Authorities

I. – The following shall be involved in drawing up the draft outline plan:

1° The representative of the State in the region;

2° The departmental councils of the departments in the region, on aspects relating to roads and digital infrastructure;

3° The metropolitan areas referred to in Title I of Book II of Part Five;

4° The public establishments referred to in Article L. 143-16 of the town planning code;

5° Local authorities with special status located within the territory of the region;

6° Public establishments for inter-communal cooperation with their own tax status with jurisdiction over local town planning plans mentioned in the first paragraph of Article L. 153-8 of the town planning code;

6° bis The population. The regional council initiates and organises the public consultation;

7° The authorities responsible for organising mobility that have drawn up a mobility plan instituted by Article L. 1214-1 of the Transport Code;

8° A committee made up of representatives of local authorities and their associations responsible for waste collection and treatment, public bodies and professional organisations concerned, eco-organisations and approved environmental protection associations;

9° The regional committee in charge of biodiversity provided for by article L. 371-3 of the Environment Code;

10° Where applicable, the massif committees provided for in Article 3 of Law no. 85-30 of 9 January 1985 relating to the development and protection of mountain areas.

The public persons mentioned in 3° to 6° of this I shall formulate proposals relating to the general rules of the draft outline plan.

II. – The following may be involved:

1° Public establishments for inter-communal cooperation with their own tax status that are not located within the perimeter of a public establishment mentioned in article L. 143-16 of the town planning code;

2° The regional economic, social and environmental council as well as chambers of agriculture, chambers of commerce and industry and chambers of trades and crafts;

III. – The regional council may consult the regional council of neighbouring regions and any other body or person on all or part of the draft plan.

IV. – The State representative in the region shall inform the region of all the necessary information, under the conditions set out in article L. 132-2 of the town planning code.

When defining energy and environmental objectives, this information may take into account the opinions of the High Council for the Climate.

I. – Sont associés à l’élaboration du projet de schéma :

1° Le représentant de l’Etat dans la région ;

2° Les conseils départementaux des départements de la région, sur les aspects relatifs à la voirie et à l’infrastructure numérique ;

3° Les métropoles mentionnées au titre Ier du livre II de la cinquième partie ;

4° Les établissements publics mentionnés à l’article L. 143-16 du code de l’urbanisme ;

5° Les collectivités territoriales à statut particulier situées sur le territoire de la région ;

6° Les établissements publics de coopération intercommunale à fiscalité propre compétents en matière de plan local d’urbanisme mentionnés au premier alinéa de l’article L. 153-8 du code de l’urbanisme ;

6° bis La population. Le conseil régional initie et organise la concertation publique ;

7° Les autorités compétentes pour l’organisation de la mobilité qui ont élaboré un plan de mobilité institué par l’article L. 1214-1 du code des transports ;

8° Un comité composé de représentants des collectivités territoriales et de leurs groupements compétents en matière de collecte et de traitement de déchets, d’organismes publics et d’organisations professionnelles concernés, d’éco-organismes et d’associations agréées de protection de l’environnement ;

9° Le comité régional en charge de la biodiversité prévu par l’article L. 371-3 du code de l’environnement ;

10° Le cas échéant, les comités de massif prévus à l’article 3 de la loi n° 85-30 du 9 janvier 1985 relative au développement et à la protection de la montagne.

Les personnes publiques mentionnées aux 3° à 6° du présent I formulent des propositions relatives aux règles générales du projet de schéma.

II. – Peuvent être associés :

1° Les établissements publics de coopération intercommunale à fiscalité propre qui ne sont pas situés dans le périmètre d’un établissement public mentionné à l’article L. 143-16 du code de l’urbanisme ;

2° Le conseil économique, social et environnemental régional ainsi que les chambres d’agriculture, les chambres de commerce et d’industrie et les chambres de métiers et de l’artisanat ;

III. – Le conseil régional peut consulter le conseil régional des régions limitrophes et tout autre organisme ou personne sur tout ou partie du projet de schéma.

IV. – Le représentant de l’Etat dans la région porte à la connaissance de la région toutes les informations nécessaires, dans les conditions prévues à l’article L. 132-2 du code de l’urbanisme.

Pour la définition des objectifs énergétiques et environnementaux, ces informations peuvent prendre en compte les avis du Haut Conseil pour le climat.
