Article L441-10 of the French Insurance Code

I. – Agreements of any kind in existence on 1 July 2017 and carrying out or providing for the transactions referred to in Article L. 441-1 must be brought into compliance with the provisions of this chapter by 31 December 2017.

Without prejudice to II, compliance with existing agreements may not result in a reduction in the service value of the annuity unit.

By way of derogation from Article L. 141-4, the policyholder shall inform members of any changes to the agreement concerning the compliance referred to in the first paragraph as part of the first annual information provided for in Article L. 441-3-1 following 1 January 2018.

II. – Agreements of any kind in existence on 1 July 2017 and carrying out or providing for transactions referred to in Article L. 441-1 may be amended in order to introduce the possibility of reducing the service value of the annuity unit in accordance with II of Article L. 441-2, in compliance with Article L. 141-4.

When, in application of article L. 141-4, a member cancels his membership because of changes made to the agreement to which he has subscribed, his vested rights, on the date scheduled for the entry into force of these changes, are converted, on the basis of actuarial equivalence, into a life annuity expressed in euros and managed outside the auxiliary allocation accounts set up for the agreement, in application of article L. 441-8. This option to terminate membership applies without prejudice to other options for transferring rights to another agreement or contract.

Article L441-10

I. – Les conventions de toute nature existant au 1er juillet 2017 et pratiquant ou prévoyant des opérations mentionnées à l’article L. 441-1 doivent être rendues conformes aux dispositions du présent chapitre avant le 31 décembre 2017.

Sans préjudice du II, la mise en conformité des conventions existantes ne peut introduire de possibilité de baisse de la valeur de service de l’unité de rente.

Par dérogation à l’article L. 141-4, le souscripteur informe les adhérents des modifications de la convention ayant pour objet la mise en conformité mentionnée au premier alinéa dans le cadre de la première information annuelle prévue à l’article L. 441-3-1 suivant le 1er janvier 2018.

II. – Les conventions de toute nature existant au 1er juillet 2017 et pratiquant ou prévoyant des opérations mentionnées à l’article L. 441-1 peuvent faire l’objet de modifications visant à introduire des possibilités de baisse de la valeur de service de l’unité de rente conformes au II de l’article L. 441-2, dans le respect de l’article L. 141-4.

Lorsqu’en application de l’article L. 141-4 un adhérent dénonce son adhésion en raison des modifications apportées à la convention à laquelle il a adhéré, ses droits acquis, à la date prévue pour l’entrée en vigueur de ces modifications, sont convertis, sur la base d’une équivalence actuarielle, en une rente viagère exprimée en euros et gérés à l’extérieur de la comptabilité auxiliaire d’affectation constituée pour la convention, en application de l’article L. 441-8. Cette possibilité de dénoncer son adhésion s’applique sans préjudice des autres possibilités de transférer ses droits vers une autre convention ou contrat.
