Article L454-4 of the French Consumer Code

The fines provided for in articles L. 454-1 to L. 454-3 may be increased, in a manner that is proportionate to the benefits derived from the offence, to 10% of average annual turnover, calculated on the basis of the last three annual turnover figures known at the time of the offence.

Les peines d’amende prévues aux articles L. 454-1 à L. 454-3 peuvent être portées, de manière proportionnée aux avantages tirés du délit, à 10 % du chiffre d’affaires moyen annuel, calculé sur les trois derniers chiffres d’affaires annuels connus à la date des faits.
