The Autorité de la concurrence shall have investigation departments headed by a rapporteur general appointed by order of the minister responsible for the economy after consulting the college.
These departments carry out the investigations necessary for the application of Titles II, III and VI of this Book.
The deputy rapporteurs general, the permanent or non-permanent rapporteurs and the investigators of the investigating departments are appointed by the rapporteur general, by decision published in the Journal officiel.
A hearing officer who is a magistrate or offers equivalent guarantees of independence and expertise is appointed by order of the Minister for the Economy after consulting the Board. As soon as the statement of objections has been sent, the Hearing Officer will, where appropriate, receive comments from respondents and referrers on the proceedings concerning them. He sends the Chairman of the Authority a report evaluating these observations and proposing, if necessary, any action that might improve the exercise of their rights by the parties.
The terms of the Hearing Officer’s involvement are specified by decree in the Conseil d’Etat.
The President delegates the authorisation of the expenses of the investigating departments to the general rapporteur.
A decree in the Conseil d’Etat determines the conditions under which the chairman of the authority represents it in all acts of civil life and is entitled to take legal action on its behalf.
