Article L4623-5-2 of the French Labour Code

A fixed-term employment contract may only be terminated once the labour inspector has established that the termination is not related to the performance of the occupational physician’s duties and does not constitute a discriminatory measure.

The employer must notify the labour inspector one month before the end of the contract.

The labour inspector will take a decision before the contract expires.

L’arrivée du terme du contrat de travail à durée déterminée n’entraîne sa rupture qu’après constatation par l’inspecteur du travail que celle-ci n’est pas en lien avec l’exercice des missions de médecin du travail et ne constitue pas une mesure discriminatoire.

L’employeur saisit l’inspecteur du travail un mois avant l’arrivée du terme.

L’inspecteur du travail statue avant la date du terme du contrat.
