The registration of a design is declared invalid by a court decision:
a) If it does not comply with the provisions of articles L. 511-1 to L. 511-8;
b) If its owner could not benefit from the protection provided for in article L. 511-9 ;
c) If the design infringes rights attached to an earlier design which has been made available to the public after the date of submission of the application for registration or, if priority is claimed, after the priority date, and which has been protected since an earlier date by a registered Community design, a French design or an international design designating France, or by an application for registration of such designs ;
d) If it infringes the copyright of a third party;
e) If a protected earlier distinctive sign is used in that design without the authorisation of its owner.
The grounds for invalidity provided for in b, c, d and e may only be invoked by the person vested with the right it opposes.
The Public Prosecutor may initiate an action for a declaration of invalidity of a design ex officio, regardless of the grounds for invalidity.
