Article L5124-1 of the French Labour Code

Unless it is an offence of fraud, as defined and punished by article 313-1, 5° of article 313-2 andarticle 313-3 of the French Criminal Code, fraudulently obtaining or attempting to obtain the benefits mentioned in articles L. 5122-1 and L. 5123-2 of this Code is punishable by the penalties set out inarticle 441-6 of the French Criminal Code. Fraudulently obtaining or attempting to fraudulently obtain these benefits is punishable by the same penalty.

Article L5124-1

Sauf constitution éventuelle du délit d’escroquerie, défini et sanctionné à l’article 313-1, au 5° de l’article 313-2 et à l’article 313-3 du code pénal, le fait de bénéficier ou de tenter de bénéficier frauduleusement des allocations mentionnées aux articles L. 5122-1 et L. 5123-2 du présent code est puni des peines prévues à l’article 441-6 du code pénal. Le fait de faire obtenir frauduleusement ou de tenter de faire obtenir frauduleusement ces allocations est puni de la même peine.
